Terms of Service

1. Eligibility

You must be at least 13 years old to use Cafe Kinship. By using the Service, you confirm that you meet this requirement and that any information you provide is accurate.

2. Your account

You're responsible for keeping your login credentials secure and for everything that happens under your account. Tell us right away if you think someone else has accessed it. We reserve the right to suspend or remove accounts that violate these Terms.

3. Your content

You own what you post — text, photos, audio, links, comments, everything. By posting it, you grant Cafe Kinship a non-exclusive, worldwide, royalty-free license to host, display, and distribute it as part of operating the Service. That license ends when you delete the content or your account, except where it's been shared by others in ways we can't retroactively undo (e.g., someone screenshotted it).

You're solely responsible for what you post. Don't post anything you don't have the rights to, and don't post anything illegal, infringing, harassing, or that violates someone else's rights.

4. Artist accounts

Artist accounts require an application and are approved at our discretion — approval isn't guaranteed. Approved applicants pay a one-time fee to unlock artist features, processed securely through Stripe. This fee is non-refundable once your account is upgraded, except where required by law.

5. Prohibited conduct

You agree not to:

• Post illegal, harassing, hateful, or sexually explicit content
• Impersonate another person or entity
• Spam, or use the Service to distribute malware
• Attempt to access other users' accounts without permission
• Circumvent a ban or suspension by creating a new account
• Use the Service in any way that violates applicable law

6. Moderation and enforcement

We may remove content, suspend accounts, or ban users who violate these Terms, at our discretion and without prior notice. Reported content is reviewed by our moderation team.

7. Third-party services

Cafe Kinship relies on third-party services to operate — including but not limited to payment processing (Stripe), hosting and analytics (Vercel), email delivery (Resend), and GIF search (GIPHY). Your use of features built on these services is also subject to those providers' own terms. We aren't responsible for their availability or conduct.

8. Disclaimer of warranties

The Service is provided "as is" and "as available," without warranties of any kind, express or implied. We don't guarantee the Service will be uninterrupted, secure, or error-free, or that content on it is accurate or reliable.

9. Limitation of liability

To the fullest extent permitted by law, Cafe Kinship and its operators won't be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, revenue, or profits, arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the amount you paid us (if any) in the 12 months before the claim arose. Some jurisdictions don't allow these limitations, so some of this may not apply to you.

10. Indemnification

You agree to indemnify and hold Cafe Kinship harmless from any claims, damages, or expenses (including reasonable legal fees) arising from your use of the Service, your content, or your violation of these Terms.

11. Termination

You can delete your account at any time from Settings. We may suspend or terminate your access for violating these Terms or for any other reason, at our discretion.

12. Governing law

These Terms are governed by the laws of the State of Arizona, without regard to conflict-of-law principles.

13. Changes to these Terms

We may update these Terms from time to time. Continued use of the Service after changes take effect means you accept the updated Terms.
